We have introduced a scheme for all our customers which is our way to protect you and make sure your property purchase is secure and trouble free . Although we are working with trustworthy and established builders and all of our properties and projects have had their Due Diligence checked (that the deeds, planning permissions and all paperwork are present and correct), we want to offer you an extra level of security and peace of mind in your purchase.
Our Scheme involves a a four step procedure that we will follow through with you in the purchase of your property through us, to make sure that everything goes smoothly.
Step 1: Using a recommended, English speaking, Turkish Solicitor;
Part of this involves using an independent Turkish based Solicitor to act on your behalf and preferably one that can speak English which we can recommend to you as a reliable choice in the area you are buying in but if you prefer you can find yourself but he/she must be prepared to go that extra way for you.
Step 2: Checking the Property;
Before anything is done, the paperwork is checked by the solicitor that the property is owned by the person selling it or if not, there is a Power of Attorney saying that the this person can sell the property on their behalf and there is no dept on it. If it’s a project, the deeds need to split and that there is planning permission.
Step 3: Preparing a legally binding contract;
A contract needs to be drawn up by a solicitor between yourself and the developer, which would be in Turkish and translated into English by a qualified translator. The solicitor should also sign the contract as a witness. If you prefer the contract can be done through a notary and officially translated.
The contract should also include money left over for snagging and a penalty clause if the off-plan project isn’t completed on time. I also suggest that the contract includes a protocol if one party wants to withdraw from the contract outlining any penalty. This has to be fair between both parties.
Step 4: Protection for your purchase;
The best protection on a property is ownership of the title deeds, but because all foreigners in Turkey have to firstly go through a military search, which checks the property isn’t in a military restricted area and that you are genuine, before the deeds can be transferred.
The process of Military Searches can take between 2 to 9 months (dependant on the area and their workload), hence a certain protection needs be given for the money you have paid towards the property, until the deeds of your property are transferred.
